TERMS AND CONDITIONS OF SERVICE
M3SCA Corp.
1. Definition of Services: M3SCA CORP (hereinafter, "the Company") provides a range of digital, creative, and technical solutions including, but not limited to: software and web development, digital asset management, technical and creative audiovisual capture, and 3D modeling services (hereinafter, "the Services").
2. Intellectual Property and Copyright: Unless otherwise agreed upon in writing, the Company retains all intellectual property rights to all materials, code, designs, and audiovisual assets created during the performance of the Services. The Client is granted a commercial use license for the specific purpose of the contracted project. The Company reserves the right to use anonymized versions of these works for its professional portfolio and self-promotion.
3. Authorizations and Third-Party Liability: It is the Client’s sole responsibility to ensure they hold all necessary rights, titles, and permissions (including property access and "Property Releases") required for the Company to perform the Services. The Client shall indemnify and hold M3SCA CORP harmless from any legal liability arising from the lack of authorization from third parties or property owners.
4. Privacy and Ethical Use of Information: M3SCA CORP is committed to protecting the privacy of its Clients and third parties. Regarding portfolio exhibition:
No disclosure: Exact addresses, financial data, end-client names, or sensitive structural blueprints will not be published.
Contextual Integrity: Audiovisual content will be used respecting the original context of its creation.
Right of Withdrawal: The Company agrees to refrain from publishing or to remove specific content from its promotional channels if the Client submits a justified request based on security or privacy concerns.
5. Limitation of Liability: The Company performs its services in accordance with industry standards. However, M3SCA CORP shall not be liable for indirect, incidental, or consequential damages resulting from technical delays, weather conditions, or decisions made by third-party platforms (such as social media networks or search engines).
6. Amendments and Entire Agreement: These terms constitute the fundamental understanding between the parties. Any modification or exclusivity agreement must be made in writing and signed by both parties to be valid and supersede this document.
